An invention patent is valid from the date of grant and lasts until the end of 20 years from the filing date/international filing date. The protection effect should be maintained every year.

The utility solution patent is valid from the date of grant and lasts until the end of 10 years from the filing date/international filing date. The protection effect should be maintained every year.

 In order to maintain the validity of the insurance policy, within 06 months before the expiration of the validity period, the insurance policy holder must submit a request for maintenance of validity. the validity period ends and the VBBH owner must pay an additional fee for late validity maintenance.

1. A dossier of request for validity maintenance includes:

+ A declaration requesting validity maintenance (made according to form 02-GH/DTVB in Appendix C of Circular 01);

+ Power of attorney (in case the request is submitted through a representative);

+ A copy of the receipt of payment of fees and charges as prescribed;

+ Other documents (if needed).

2. Time limit for application appraisal

– Time limit for assessment: 01 month from the date of application submission

– Implementation results: Issue a Notice of recognition of the validity maintenance of the insurance policy and publish it in the Official Gazette of SHCN or a decision to refuse to maintain the validity of the insurance policy.

3. Fees and charges

+ Fee to maintain validity: 100,000 VND/point

+ Late maintenance fee: 10% maintenance fee/monthly late payment

+ Fee for appraisal of maintenance requirements: 160,000 VND/VBBH

+ Fee for using VBBH (by year):

Years 1 -2: 300,000 VND/year/point

Year 3-4: 500,000 VND/year/point

Year 5-6: 800,000 VND/year/point

Years 7-8: 1,200,000 VND/year/point

Year 9-10: 1,800,000 VND/year/point

Years 11-13: 2,500,000 VND/year/point

Year 14-16: 3,300,000 VND/year/point

Years 17-20: VND 4,200,000/year/point

+ Fee for publication of notice of maintenance record: 120,000 VND/application

+ Registration fee for information to maintain validity: 120,000 VND/VBBH
