– 02 Patent registration declarations, typed according to form No. 01-SC Appendix A of Circular No. 01/2007/TT-BKHCN;

– 02 Description of invention/utility solution; The description of the invention/utility solution must satisfy the provisions of Point 23.6 of Circular No. 01/2007/TT-BKHCN. Description of invention/utility solution including Description, Claim and Drawing (if any).

The description must fully and clearly state the nature of the invention according to the following contents:

+ Name of invention/utility solution;

+ The field of using inventions/utility solutions;

+ Technical status of the field of use of the invention/utility solution;

+ The technical nature of the invention/utility solution;

+ Brief description of the attached drawings (if any);

+ Detailed description of the implementation options of the invention/utility solution;

+ Examples of invention/utility solutions;

+ What benefits (effectiveness) can be achieved].

Claims are separated after the description, the claims are used to define the scope of industrial property rights to the invention. The protection claim must be presented briefly, clearly, in accordance with the description and drawings, in which the new signs of the object of protection must be clarified.

Drawings, diagrams (if any): separated into separate pages.

– 02 Summary of invention/utility solution. Abstracts of invention/utility solutions should not exceed 150 words and must be separated into separate pages. The abstract of the invention/utility solution is not required to be filed at the time of application and may be added later by the applicant;

– Proof of payment of fees and charges.

  1. Other documents (if any)

– Power of attorney (if the application for an invention/utility solution is filed through an industrial property representation service organization);

– The transfer of the right to file an application (if any);

– Documents confirming the right to registration (if beneficiary is from someone else);

– Documents proving the right of priority (if the patent application has a claim for priority right).

 

  1. General requirements for application

– Each application may only request for one protection title and the type of protection title requested for grant must be suitable for the object of technical solution stated in the application;

– All documents of the application must be made in Vietnamese. For documents made in other languages ​​as prescribed at Points 7.3 and 7.4 of Circular 01/2007/TT-BKHCN, they must be translated into Vietnamese;

– All documents must be presented vertically (only drawings, diagrams and tables can be presented horizontally) on one side of A4 size paper (210mm x 297mm), including four margins. side, each margin is 20mm wide, in Times New Roman font, font size not smaller than 13, except for supporting documents whose origin is not intended to be included in the application;

– For documents that need to be made according to the form, it is mandatory to use those forms and fill in the required information in the appropriate places;

– If each type of document includes many pages, each page must have the page number in Arabic numerals;

– Documents must be typed or printed with indelible ink, in a clear, clean, unblemished, unmodified manner; In case of detecting insignificant spelling errors in documents submitted to the NOIP, the applicant may correct such errors, but the corrected signature must be signed at the place of correction. (and stamp, if any) of the applicant;

– Terminology used in the application must be consistent and common (do not use dialects, rare words, self-created words). Symbols, units of measurement, electronic fonts, spelling rules used in the application must comply with Vietnamese standards);

– An application may be accompanied by an additional document that is an electronic data carrier of part or all of the content of the application.
