Step 1: Submit the application at the National Office of Intellectual Property of Vietnam and pay the registration fee

Individuals and organizations can apply for trademark registration through the following forms:

  • Apply directly at the headquarters of the National Office of Intellectual Property of Vietnam or the Representative Office of the National Office of Intellectual Property in Ho Chi Minh City, or Da Nang City.
  • Individuals and organizations can apply through the postal system to the headquarters of the National Office of Intellectual Property or the Representative Office of the National Office of Intellectual Property.
  • Individuals and organizations can apply for trademark registration online: The applicant needs a digital certificate and digital signature, registers an account on the Online Application Receiving System and is approved by the National Office of Intellectual Property. approve the account to perform SHCN registration transactions.

As soon as the application for registration is submitted, the applicant must pay the registration fee to the National Office of Intellectual Property.

Step 2: Formal examination of the trademark application

After the application is submitted to the Bureau, a formal examination will be conducted: If the application is accepted, the valid application will be published in the Official Gazette of the NOIP, the Industrial Property Official Gazette is published monthly and can be viewed on the website of the National Office of Intellectual Property.

Step 3: Examine the content of the trademark application

After the trademark application is published in the Official Gazette, a substantive examination of the mark will be carried out.

Step 4: Notice of intention to grant/refuse to grant diplomas

At the end of the substantive examination, the NOIP shall issue a notice of its intention to grant or refuse to grant a trademark protection title, clearly stating the reason.

Step 5: Pay the fee for granting a trademark registration certificate

After receiving the notice of intention to grant a trademark, the applicant pays the trademark licensing fee.

 

  1. Time limit for processing trademark applications

From the date of receipt by the NOIP, the trademark registration application shall be considered in the following order:

– Formal assessment: 01 month

– Announcement of application: within 2 months from the date the trademark registration application has a decision on acceptance of a valid application

– Substantive examination: no more than 09 months from the date of application publication.

 

  1. Trademark registration fees and charges include:

– Application fee: 150,000VND

– Application publication fee: 120,000 VND

– Searching fee for serving people’s income: 180,000 VND / 01 group of products and services

– Search fee for the 7th product or service onwards: 30,000 VND / 01 product or service

– Content appraisal fee: VND 550,000 / 01 group of products and services

– Content appraisal fee for the 7th product/service onwards: 120,000VND/01 product or service.
